Hennan Regency Resort and Spa Boracay denies losing land dispute case to Supreme Court

BORACAY Island, Malay, Aklan – The management of the Hennan Regency Resort and Spa here has denied reports that its founder Henry O. Chusuey has denied losing to a land dispute case decided by the Supreme Court.

In a statement released to their official Facebook page Monday, the Hennan Regency Resorts ‘are not parties to the subject case.’

The statement developed after ‘news reports’ circulated in a Facebook page indicating that the Hennan lost its battle against a land dispute at their property at Barangay Manoc-manoc here.

“This is in response to a Facebook post circulating around that Henann Regency Resort & Spa or Mr. Henry O. Chusuey lost a case in the Supreme Court. Please take note that Henann Regency Resort & Spa or Mr. Henry O. Chusuey are not parties to the subject case.,” the statement reads.

“The Henann Group of Resorts or Mr. Henry O. Chusuey for that matter, are not involved in a land dispute as alluded to in the Facebook post. It is also not true that Henann Regency Resort & Spa has a hotel adjacent to the disputed property, which is located at Brgy. Manoc-Manoc. The Henann Group of Resorts or Mr. Chusuey is not a party to the Supreme Court case mentioned in the said Facebook post,” it added.

According to a Supreme Court decision under G.R.no.219446, the case stemmed from the complaint of peasant settler Antonio Pelayo against the Golden Boracay Realty Incorporated.

The decision was promulgated July 14, 2021 but was only posted in the SC website dated December 3, 2021.

“Before the Court is a Petition for Review on Certiorari (Petition) under Rule 45of the Rules of Court Assailing the decision dated November 5, 2014 and Resolution dated July 8, 2015 of the Court of Appeals. The CA granted the appeal of respondent Antonio Pelayo and reversed as well as set aside the Decision of the Regional Trial Court in Civil Case No. 6893. The CA Resolution denied the Motion for Reconsideration of petitioner Golden Boracay Incorporated (GBRI),” the decisions stated.

The 15 pages’ decision was penned by SC Associate Justice Benjamin S. Caguioa.

The land dispute being claimed is a 2.32-hectare beachfront property in Manoc-manoc, Boracay.
